Divorce in Maryland

In Maryland, divorce is called “absolute divorce.” What is referred to as a legal separation in other states is called a “limited divorce” in Maryland.

In order to obtain an absolute divorce in Maryland, you and your spouse must live separate and apart for a minimum of 12 months prior to filing. Otherwise, you will have to provide the court with “grounds” for the divorce, which requires you to prove that your spouse engaged in misconduct that broke up the marriage.

These grounds include:

  • Adultery.
  • Insanity along with commitment to a mental institution.
  • Cruelty or vicious behavior.
  • Desertion.
  • A criminal conviction.

It is important to remember that if you fail to provide adequate proof to the court, the court will likely rule in favor of your spouse, which could be financially costly.

After filing for divorce, you will have to resolve any issues related to the divorce, including child support, custody, and visitation rights, spousal support, and the division of marital property and debts. In Maryland, the division and distribution of marital property is based on “equitable” distribution, which may or may not equate to an even split. Courts will look at various factors to determine what is fair in terms of dividing assets, property, and debts between you and your spouse.

Perhaps the best way to resolve your divorce is through negotiation process, and/or mediation process to avoid a protracted, expensive, and contentious court battle. Once you and your spouse come to an agreement concerning all of the divorce issues, it can be drafted by your divorce attorney and submitted to the court for approval. At the Law Office of Eshigo P. Okasili, LLC, we offer a personalized approach to helping you resolve your divorce in the most efficient and amicable way possible.
